Welcome to Fitntial. These Terms and Conditions (the "Terms") govern your access to and use of the Fitntial mobile application and related services (together, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
The Service is published and operated by:
Hosting: the website fitntial.tech is hosted by OVH SAS, 2 rue Kellermann, 59100 Roubaix, France
(www.ovh.com). Application data is processed on
Google Firebase infrastructure operated by Google Ireland Limited.
"Fitntial" is the commercial name of the mobile application published by KEJ.
Fitntial is a mobile application providing fitness, nutrition and wellness features, including:
The Service is offered on a freemium basis: a free tier with limited features, and a paid subscription ("Best version of myself" plan) unlocking the full feature set.
You must be at least 16 years old to create an account and use the Service. If you are between 16 and 18, you represent that you have obtained the consent of a parent or legal guardian.
The Service is intended for personal, non-commercial use by individuals who are in good general health and able to engage in physical activity without medical restriction. See the health disclaimer below.
You must create an account to access most features. You agree to provide accurate, current and complete information, and to keep your credentials confidential. You are responsible for all activity that occurs under your account.
You may delete your account at any time, free of charge, directly from the app (Profile → Settings → Delete Account) or by following the procedure described on our account deletion page.
The Service is available in two tiers:
Current pricing is displayed in the app and on Google Play before you subscribe. Prices include applicable VAT/GST for your country.
Subscriptions are purchased through Google Play Billing. Payments, refunds and renewal processing are handled by Google according to the Google Play Terms of Service. KEJ does not directly collect or store your payment details.
Subscriptions are automatically renewed at the end of each billing period at the then-current price, unless cancelled at least 24 hours before the renewal date via the Google Play Store.
Receipts and invoices for subscription purchases are issued by Google Play and available in your Google account. For a specific VAT-compliant invoice in the name of a company, contact support@fitntial.com.
In accordance with Articles L.221-18 and following of the French Consumer Code, EU consumers have a 14-day right of withdrawal from the date of subscription, without needing to justify the decision or pay any penalty.
To exercise your right of withdrawal (when still applicable), send a clear statement to support@fitntial.com mentioning your Google Play order ID and the email linked to your Fitntial account. Refunds will be processed through Google Play.
You can cancel your subscription at any time. Cancellation prevents future renewals but does not entitle you to a refund of the current billing period, except where required by applicable law (see section 6).
To cancel, open the Google Play Store → profile icon → Payments & subscriptions → Subscriptions → Fitntial → Cancel subscription.
The Service offers general fitness, nutrition and wellness information intended for healthy adults. The content, programs, recipes, nutrition plans and recommendations (including those generated by artificial intelligence) are for informational purposes only and are not a substitute for professional medical, nutritional or psychological advice.
Before starting any exercise program, dietary change, or weight-loss plan, you should consult a qualified healthcare professional, particularly if you:
You assume all risks associated with exercise, dietary changes and use of the Service. Stop immediately and seek medical attention if you experience pain, dizziness, shortness of breath or any unusual symptoms.
KEJ disclaims any liability for injury, health condition, or loss resulting from the use of the Service, to the fullest extent permitted by applicable law.
The Service may allow you to post content such as comments, challenge entries, custom recipes, photos (including profile pictures) and workout data (together, "User Content"). You retain ownership of your User Content.
By submitting User Content, you grant KEJ a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, display, adapt and distribute such content, solely for the purposes of operating, providing and improving the Service. This licence terminates when you delete the relevant User Content, except: (i) for content shared with other users, which may remain visible in their activity; (ii) for anonymized or aggregated data; (iii) as required by law or for legitimate defence of legal claims.
You represent and warrant that:
KEJ may, but is not obligated to, review, moderate, remove or disable access to any User Content that violates these Terms or applicable law, without prior notice. Repeat violations may result in suspension or termination of your account.
You agree not to:
The Service, including its software, design, trademarks (notably "Fitntial"), logos, graphics, text, videos, recipes, workout programs and AI-generated content, is owned by KEJ or its licensors and is protected by French, EU and international intellectual property laws.
KEJ grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the Service for personal, non-commercial use, subject to these Terms. No other right or licence is granted, expressly or implicitly.
KEJ processes your personal data in accordance with the Privacy Policy, which forms an integral part of these Terms. Processing is carried out in compliance with the EU General Data Protection Regulation (GDPR) and the French Data Protection Act ("Loi Informatique et Libertés").
You have the right to access, rectify, delete, restrict, or object to the processing of your personal data, as well as the right to data portability. You may exercise these rights by contacting support@fitntial.com or by deleting your account directly from the app.
You also have the right to lodge a complaint with the French data protection authority, the CNIL (www.cnil.fr).
The Service is provided on an "as is" and "as available" basis. KEJ does not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses.
To the fullest extent permitted by applicable law, KEJ's total liability to you for any claim arising out of or related to the Service is limited to the amounts you paid to KEJ through the Service during the twelve (12) months preceding the event giving rise to the claim.
KEJ shall not be liable for indirect, incidental, special, consequential or punitive damages (including loss of profits, data, or goodwill), whether based on contract, tort or any other legal theory.
Nothing in these Terms excludes or limits KEJ's liability for: (i) gross negligence or wilful misconduct; (ii) death or personal injury caused by its negligence; or (iii) any other liability that cannot be excluded under applicable law.
KEJ may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, engage in fraudulent or unlawful activity, or if required by law.
You may stop using the Service and delete your account at any time. Upon termination, sections 6, 9.2, 11, 13, 16 and any other provisions that by their nature should survive will remain in effect.
KEJ may update these Terms from time to time to reflect changes in the Service, applicable law, or business operations. The "Last updated" date at the top of this page indicates the latest revision.
Material changes will be notified to you through the app or by email at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and delete your account.
These Terms are governed by French law, without regard to its conflict of laws rules. Consumers benefit from the mandatory protections of the law of their country of residence.
In case of dispute, we encourage you to contact us first at support@fitntial.com to seek an amicable resolution.
Subject to mandatory provisions of consumer protection law, any dispute that cannot be resolved amicably shall be submitted to the competent courts of Lille, France.
